General Terms & Condition

 The document outlines in summary a
comprehensive overview of the terms and conditions governing E Hawker’s
operations for both buyers and sellers. It establishes clear guidelines for
item conditions and ratings, payments, checkouts, collection, refunds/returns,
vendor responsibility and packaging.  Catering to various scenario and
potential issues that may arise in the auctioning proses.  The detailed
breakdown of the rules and regulations ensures transparency and clarity,
facilitating a fair and efficient marketplace for both the buyers and sellers.

 The items are to the best of E Hawker’s knowledge an
authentic item. All items will have a general item rating:

  • Brand
    new – Refund Available
  • Like
    new near perfect condition – Refund Available
  • Used
    minor related wear – Refund Available
  • Well
    used – No Refund Available

All items will also have a general item rating:

  • 100%
    Present working and complete – Refund Available
  • Not
    complete – No Refund Available
  • Not
    working – No refund Available

Please take note that refunds will be available on items
where a refund is applicable, when an item is secured by placing a bid or
order, E Hawker will see that as a binding acceptance of the above-mentioned
condition.  Please, therefore, make sure you are happy with the condition
of the items No cancellation of an item will be allowed.

 Payments 

All goods must be paid for immediately.  Please take
note that no bids will be able to be placed when payment of previous orders is
still outstanding.  To avoid accounts being suspended, send proof of
payment to info@ehawker.co.za.
Alternatively, make use of the E Hawker Wallet, where orders are processed
immediately.  Please take note that when paying via YOCO, a 5% admin fee
will be added.  Cash payments are accepted at any ABSA ATM.  Deposits
should be more than order; change will be added to your wallet for future
purchases.  Please note that in branch cash payments are not allowed, Fees
are to be added to the buyers account and goods are not to be released for
in-branch payments.

 Checkouts 

  • Checkouts
    needs to be completed after all auctions have closed and no later than
    11h00 the following day. All unchecked out items will be relisted, and
    accounts closed and blocked. 

Collection, Transport and Delivery

  • Please
    take note that goods need to be collected within 2 weeks.
      Please note failure to collect within the timeframe will
    result in blocked bids.  To reopen bids, arrange collection of all
    items.

      orders marked/notified “Ready for collection” can be collected.
    • To
      track orders please click “My Account” – Click “Order”.
  • Collection
    Monday to Friday Between 9H00 and 16H00. 
  • Please
    note all orders to be collected by the buyer from E Hawker.  No
    deliveries available.  Buyers are welcome to arrange their own
    transport for collection of larger items. Please note all refunds voided
    when using a 3rd party to collect on your behalf.
  • Max
    time allowed for any order is 30 days, after which all items not collected
    will result in disposes of items with no refund to buyer.

 Refunds / Returns

  • Please
    take note refunds and returns will only be issued on items where a refund
    is applicable. To log a refund request, click “My Account – Click Orders –
    Click Refund. Refund will only be available for 7 days.  Long stay
    orders and collections after the 7-day period will have no refunds as the
    refund period has lapsed.
  • Please
    note all refunds voided when using a 3rd party to collect
    on your behalf.
  • All
    refunds to be for the sellers account, where applicable.

Other

Without giving notice to anyone, E Hawker reserves the right
to alter the date, timing, or removal of item from portal of any auction
scheduled. This may be done in response to a seller’s delay in shipping an
item, failure to supply or damage to an item during transportation.

Buyers Commissions & Memberships 

Standard Buyers Membership

  • Once-off registration fee @ R100.00 (Payable via payfast or EFT).  The fee is for a lifetime account.  You do not have to register for every auction.
  • Commission
    – 15% + R15.00 Per Lot (Vat) Inc.
  • Buy
    on all auctions – Yes.
  • Collection
    of goods – One collection needed minimum once a week. Bids to be blocked
    while goods have not been collected. 
  • Payment
    of orders – All orders to be paid in full 24 hours after auction have
    closed. Failure to pay will result in account suspension. Please note
    orders will only be prepared once payment or proof of payment has been
    received from the banking portal.  
  • Please
    note account suspension will void registration fee.

General Terms and Conditions – All Vendors

Item Condition 

The seller is solely accountable for providing accurate
disclosures about all items.  When presenting a product for sale, it is
important to disclose any flaws, damages, or repairs that may exist.

Item ownership 

No goods will be offered that have been reported stolen, are
the subject of a contract with a third party or are subject to a lending
arrangement. All products up for sale must be the seller’s property.  If
you sell something for a third party for whom you have the required
authorization in writing, E Hawker won’t be held liable for any disputes that
might come up with sellers or vendors.

Refunds / Returns

  • Please
    take note refunds and returns will be granted to the buyer where a refund
    is applicable for a period of 7days.
  • Items
    listed without a refund may still be refundable if E Hawker can determine
    that there where malicious intent when creating the listing. i.e. false
    pretences, contradicting information, or item not in general condition as
    advertised on the listing.
  • Please
    note any reports from buyers after 7 days that have a reasonable request
    for refund could be added to seller’s account.
  • Continues
    refunds on vendor profile could result in account suspension.
  • Please
    note refund processed will be on the hammer price and not the price after
    commissions.
  • Items
    with a refund will not be relisted on E Hawker and would need to be
    collected by the seller.  Failure to collect will result in items
    being disposed of within 7 days, with no compensation to the seller.

Packaging

  • General
    packaging requirements: The vendor is required to provide packing. Use a
    suitable sealed box or thick plastic bags that are transparent. Items will
    not be accepted at all and will be disposed of without paying the vendor
    if the packaging does not adhere to E Hawker requirements. 

General Vendors

Commission Structure:

  • Hammer
    Price @ 17.5% Commission + R10.00 per item.
  • Withdrawal
    Charges = R10.00 

All commissions and fees are VAT Inclusive.

Additional Info

  • Sell
    on scheduled auctions only.
  • All
    auctions to close to the highest bidder with no reserve.
  • Answer
    queries from buyers.
  • Publish
    items –All items to go through moderator approval.  Approval waiting
    time – up to 1 working day.
  • Vendor
    to select auction closing day.  Moderators to determine auction
    closing time.
  • Set
    bid increments – Moderator will add the appropriate bid increments.
  • When
    product has been approved will an automated SKU be generated. Items must
    be packed according to E Hawker acceptable packaging guidelines. All items
    to have a visible SKU on item / box / bag upon delivery.
  • E
    Hawker will not accept the drop off of any items that have not been upload
    and approved by moderators. All items dropped off in advance will be
    disposed of with no payment to vendors.  All items dropped without a
    visible SKU added will be disposed of with no payment to vendors.
  • All
    items to be dropped off 1 day before auctions closes. Failure to supply E
    Hawker with listed goods will result in account suspension.
  • Seller
    to drop goods @ E Hawker warehouse, Monday – Friday between 9H00 and 16H00
  • Payment
    and withdrawal only available after waiting period has lapsed on all
    qualified items. An item will be seen as qualified once auction have
    closed successfully / buyer has completed checkout and payment / refund
    period has lapsed.
  • All
    unchecked out items after a reasonable timeframe will be relisted on the
    next available auction, without the notice to the seller.
  • Withdrawal
    waiting period – 7 Days.
  • Refunds/Return
    policy – 7 days.

Any items published on E Hawker may not be removed or
withdrawn for any reason whatsoever.  Withdrawing items from auction could
lead to account closure.

 

 

Emigrations, Liquidations & Deceased Estates

Commission Structure: – Item based tiered structure.

  • Hammer
    Price @ 17.5% Commission + R10.00 per item.
  • Withdrawal
    Charges = R10.00 

All commissions and fees are VAT Inclusive.

Additional Info

  • All
    items to be uploaded and submitted by the seller to your E Hawker
    Dashboard.
  • Additional
    charge optional if E Hawker does the inventory capture and upload.
  • Special
    auction scheduled for complete sale.
  • All
    auctions to close to the highest bidder with no reserve.
  • Publish
    items –All items to go through moderator approval.  Approval waiting
    time – up to 1 working day.
  • Auction
    closing date to be scheduled as arranged before collection needed.
  • Set
    bid increments – Moderator will add the appropriate bid increments.
  • When
    product has been approved will an automated SKU be generated. Items must
    be packed according to E Hawker acceptable packaging guidelines. All items
    to have a visible SKU on item / box / bag when items are collected.
  • Collection
    of items to be booked via 3rd party (Loadit.Africa) –
    quotes of collection cost to be advised in advance to the seller.
  • Payment
    of 75% of complete sale after commissions to be made on collection date.
    Payments are made via eft and will be paid and cleared.  25% will be
    retained and paid out after refund period has lapsed.
  • All
    unchecked out items after a reasonable timeframe will be relisted on the
    next available auction, without the notice to the seller.
  • Refunds/Return
    policy – 7 days.

Any items published on E Hawker may not be removed or
withdrawn for any reason whatsoever.  Withdrawing items from auction could
lead to account closure and cancelation of complete sale.
